MBE Question of the Day

A bully has threatened to kill a student on sight. The bully, intending merely to
frighten the student, pulls out an unloaded gun. The student, believing he is about to
die, shoots the bully, killing him.

The student should be found guilty of:

(A) Murder.
(B) Voluntary manslaughter.
(C) Involuntary manslaughter.
(D) No crime.
