MBE Question of the Day

A chairman and the CEO of a company got together and planned to destroy a garage that
was owned by their chief competitor. They did not want to kill anyone, so they set the
fuse to go off at midnight when they thought no one would be in the garage. The CEO
prepared the explosive device and the chairman placed the explosive device in the
garage and lit the fuse. The device exploded as planned at midnight, but a homeless man
was crushed in the explosion while he was sleeping in the stairwell.

Who can be charged with murder?

(A) The CEO only, because he prepared the explosive device.
(B) The chairman only, because he placed the explosive device.
(C) Neither, because they had no intent to harm anyone and did not know the
man was sleeping in the stairwell.
(D) Both the CEO and chairman.
