MBE Question of the Day

A professor is suing a driver for causing a vehicular crash that seriously injured the professor. The professor testified that the
accident occurred three weeks before he was scheduled to take a certification exam. The defendant sought to present a copy of the
professor’s official exam registration form, evidencing the fact that the accident actually took place four weeks before the exam. The professor’s attorney objects.
The trial court should:
(A) Admit the evidence because it is relevant as to the time period between the accident and the scheduled
examination.
(B) Admit the evidence because the registration form is a past recollection recorded.
(C) Not admit the evidence because the contents of the registration form are
hearsay not within any exception.
(D) Not admit the evidence because the time lapse is not material.
