MBE Question of the Day

A small church uses a drug in its religious ceremonies, the use of which has been banned entirely by state law due in response to a
serious drug problem within the state, with many people addicted to that particular drug. State officials seized the substance from the
church and the church sued in federal court seeking an injunction that would enjoin the state from enforcing its drug laws against the
church. The state based its argument on the First Amendment.
What is the likely result?
(A) The court will grant an injunction on the ground that the state cannot demonstrate a compelling interest in
enforcing the law against the church.
(B) The court will grant an injunction on the ground that the statute was not
within the state’s powers.
(C) The court will deny the injunction on the ground that the statute is neutral and of general applicability and serves a compelling state interest in banning the use of harmful substances.
(D) The court will deny the injunction on the ground that it is implausible that the church needs the drug to practice
its religion.
