MBE Question of the Day

The defendant took a motorcycle and sped off on it without consent of the owner. After the defendant had driven the motorcycle ten
blocks, he was involved in an accident with a bus. The motorcycle was destroyed. After spending a month in the hospital, the
defendant was arrested upon release and charged with larceny of the motorcycle. At his trial, the defendant gave testimony that
he had taken the motorcycle just to go to the local bar a mile away. The defendant also stated he was going to leave the motorcycle
outside the bar because he didn’t believe in drinking and driving, and would return it later after becoming sober. If the finders of fact believe the defendant, they should
(A) Not convict, because he did not ride the motorcycle far away enough from where he took it.
(B) Not convict, because what he planned to do with the property would not permanently deprive the
owner of the property.
(C) Convict, because he was responsible for permanently depriving the owner of the motorcycle.
(D) Convict, because he did not intend to return the motorcycle to the location from which he had originally taken it.
