A law firm had a new air conditioning unit installed in its building. A month after the installation, a leak developed which caused extensive damage to the firm’s offices. The firm’s insurer covered the cost of repair and wanted to sue the company that installed the air conditioning unit to recover its costs. The insurer is incorporated and maintains its principal place of business in State A. The law firm and the company that installed the air conditioning unit are incorporated in State B.

Can the insurer sue the installer in federal court?

(A) Yes, because the requirements for diversity jurisdiction are satisfied between the insurer and the installer.

(B) Yes, as long as the insurer can prove that the damages are more than $75,000.

(C) No, because the requirements for diversity jurisdiction are not satisfied between the insurer and the installer.
